We are proud to announce that Butters Brazilian LLP Partner Alec S. Pine secured a $1 million settlement for an elderly pedestrian who suffered catastrophic injuries after a distracted driver struck him while he was lawfully crossing in a marked crosswalk in a Boston suburb. The settlement exhausted the available liability coverage.

Last fall, our client left home early in the morning to take his daily stroll. As he crossed the street in a marked crosswalk, the driver of a van diverted his attention, proceeded through a red light, and struck him. The force of the impact threw our client approximately 10 feet and he was rendered unconscious.

The evidence established a compelling liability case. The driver admitted to taking his eyes off the roadway and did not see our client before impact. An independent eyewitness also confirmed that our client was in the crosswalk and that the van entered the intersection against a red light.

Our client sustained devastating injuries, including organ damage, multiple rib and spinal fractures, and symptoms affecting his strength, balance, and mobility. He spent over a month in inpatient care before returning home, where he continued to struggle with pain, limited mobility, and a loss of independence.

The insurer ultimately tendered the full policy limits, the maximum available under the at-fault driver’s coverage regardless of the true scope of our client’s damages.

Our client showed extraordinary resilience throughout a long and difficult recovery. Butters Brazilian LLP was honored to advocate for him and secure funds that will help him get his life back on track.
